Case Study · Records Reconstruction

A retired agricultural worker with 28 years of fragmented employment records

Challenge

The client had worked for six different employers across three decades, several of which had either dissolved or been acquired. Fewer than twelve years of contribution records could be located through standard channels. The client's pension entitlement was calculated by the relevant authority on the basis of available records only, leaving a significant portion unaccounted for.

What We Did

We traced successor entities for three of the dissolved employers and made formal record requests to each. For the remaining two employers, we contacted the relevant labour department archives and were able to recover partial records. We then prepared witness statements from two former colleagues who could attest to the client's employment periods.

Outcome

An additional 11 years of contribution records were documented or attested. The authority accepted the reconstruction and recalculated entitlement accordingly. The process took approximately four months from initial engagement to submission of the completed file. The client's recalculated entitlement was materially higher than the original figure.

A scheme administrator's calculation disputed by a retiring teacher

Challenge

The client had received a pension estimate from the administrator of her former employer's occupational scheme. The figure was lower than she had calculated based on her reading of the scheme booklet. The administrator maintained the calculation was correct but did not provide a worked example, and the client was unable to identify where the discrepancy arose.

What We Did

We obtained the full scheme documentation, which was more detailed than the client-facing booklet. We identified a transition provision that affected benefits for members who had worked across different earning bands during a specific period. The administrator had applied this provision correctly, but had not explained it. We confirmed the administrator's figure and provided the client with a written explanation of the applicable rule.

Outcome

The administrator's calculation was confirmed as accurate. While this was not the result the client had hoped for, she described the outcome as satisfactory because she could now understand the basis for the figure. The engagement took seven weeks. The written summary was shared with a family member who had legal training and confirmed the analysis was sound.

Case Study · Dual-Track Coordination

A public sector retiree receiving both state and occupational pension streams

Challenge

The client had worked for a provincial government body and later for a private hospital. Both employments had generated pension entitlement. When both streams became payable, the combined figure was lower than the client expected based on separate statements from each administrator. Neither administrator was willing to engage with the other's calculation.

What We Did

We read both sets of scheme rules and identified an abatement provision in the occupational scheme that reduced the private entitlement where the member also received a public sector pension above a certain threshold. We confirmed that this provision had been applied, drafted a formal letter to the private scheme administrator requesting confirmation of the calculation basis, and obtained a written response that confirmed the position and provided a worked example.

Outcome

The combined entitlement was confirmed as accurate once the abatement provision was understood. The client received a clear written explanation from the practice and a confirmed response from the administrator. The matter took nine months. The client chose to accept the position and indicated that clarity was the primary objective in any event.
