Terms & Conditions
1. Definitions
- Practice: Anong Advocates, a legal practice registered in Thailand
- Client: Any individual who engages the Practice to undertake legal work
- Enquirer: Any individual who submits a contact form or makes an initial enquiry without yet entering into an engagement
- Engagement: The formal agreement between the Practice and a Client, confirmed in writing, for the provision of a specific service
- Services: The pension legal services offered by the Practice, as described on this website
- Fee: The amount agreed in writing for a specific service
2. Acceptance of Terms
By submitting an enquiry form on our website or by confirming an engagement in writing, you agree to these Terms and Conditions. You must be at least 18 years of age and have full legal capacity to enter into a binding agreement. If you are acting on behalf of another person, you confirm that you are authorised to do so.
3. Services Provided
Anong Advocates offers three categories of pension legal service:
- Pension Records Reconstruction — for clients with incomplete or partially lost contribution records
- Occupational Pension Scheme Review — for clients seeking an independent review of their entitlement under a former employer's scheme
- Dual-Track Pension Coordination — for clients whose state and private pension streams interact in a way they wish examined
Services are provided from our office in Khon Kaen, Thailand. While correspondence with third parties may involve entities outside Thailand, we do not provide advice governed by the laws of any jurisdiction other than Thailand without written agreement.
4. Engagement Process
An engagement begins when both parties have confirmed the scope and fee in writing. A verbal discussion, email enquiry, or submission of a contact form does not constitute an engagement. Work does not begin until the engagement letter has been confirmed and, where applicable, an initial payment has been received.
The Practice reserves the right to decline any enquiry without providing a reason, including enquiries where the matter falls outside the scope of our services or where a conflict of interest exists.
5. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete information relevant to the matter
- Informing the Practice promptly of any change in circumstances that may affect the engagement
- Responding to reasonable requests for documents or instructions within a reasonable time
- Paying fees on the terms agreed at the outset of the engagement
Clients must not submit false or misleading information. Where false information is provided and relied upon, the Practice accepts no liability for outcomes arising from that information.
6. Fees and Payment
Fees for standard engagements are stated at the outset and confirmed in the engagement letter. All fees are denominated in Thai Baht (฿). Current service fees are:
- Pension Records Reconstruction: ฿5,400
- Occupational Pension Scheme Review: ฿11,200
- Dual-Track Pension Coordination: ฿29,800
Where a matter involves unusual complexity that materially increases the work required, any additional fee will be discussed with the client before the additional work is undertaken. No additional charges are applied without prior written agreement.
Payment terms are specified in the engagement letter. Where payment is not received in accordance with those terms, the Practice may suspend work on the matter until payment is made.
7. Confidentiality
All information provided by clients is treated as confidential. The Practice will not disclose client information to third parties except where required to progress the matter with the client's knowledge, where required by law, or where the client has given consent. This obligation survives the conclusion of any engagement.
8. Disclaimers
The Practice provides legal services with reasonable care and professional judgment. However, legal outcomes cannot be assured. The results of any engagement depend on the information available, the response of third parties, and the applicable rules and regulations.
Information on this website is provided for general informational purposes only and does not constitute legal advice. An engagement letter is required before any advice given by the Practice is to be relied upon.
The Practice does not make predictions about regulatory or legislative changes that may affect pension entitlement after the conclusion of an engagement.
9. Limitation of Liability
The Practice's liability in connection with any engagement is limited to the fee paid for that engagement, except where liability arises from fraud, wilful misconduct, or gross negligence. The Practice is not liable for indirect or consequential losses, including loss of future pension income, arising from the outcome of an engagement.
These limitations do not affect statutory rights that cannot be excluded or limited under Thai law.
10. Intellectual Property
Written summaries, position papers, and other documents produced by the Practice for a client become the property of the client upon payment of the agreed fee. The methodologies, templates, and internal processes used by the Practice remain the intellectual property of Anong Advocates.
Content on this website is owned by Anong Advocates. You may not reproduce it without written permission.
11. Termination
Either party may terminate an engagement by written notice. Where the client terminates, fees are due for work completed up to the date of termination. Where the Practice terminates (for example, due to a conflict of interest that becomes apparent during the engagement), fees are due for work completed and the client will be informed promptly.
On termination, the Practice will provide the client with a copy of work completed to that point. Client files are retained in accordance with our Privacy Policy.
12. Dispute Resolution
In the event of a dispute, the parties agree first to seek resolution through direct discussion. If the dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation. If mediation is unsuccessful, the dispute will be subject to the jurisdiction of the courts of Khon Kaen Province, Thailand. These Terms are governed by the laws of Thailand.
13. General Provisions
- Entire agreement: These Terms, together with the engagement letter, constitute the entire agreement between the parties
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision
- Assignment: Neither party may assign their rights under an engagement without the written consent of the other
- Notices: Formal notices should be sent by email with read receipt or by registered post to the addresses confirmed at engagement
14. Changes to These Terms
We may update these Terms from time to time. The date at the top of this page reflects when they were last revised. Changes do not affect engagements already underway. Continued use of the website after an update constitutes acceptance of the revised Terms.
